El Supremo de EEUU da luz verde a las primeras ejecuciones federales en 17 años
El Tribunal Supremo de Estados Unidos ha autorizado este martes que puedan llevarse a cabo las primeras ejecuciones federales en 17 años en el país tras revocar el fallo de una magistrada que había paralizado temporalmente esta medida, decidida por la Administración de Donald Trump el año pasado.
El fallo, aprobado por cinco votos a favor y dos en contra, se ha emitido en la madrugada del martes después de que el Departamento de Justicia hubiera apelado la decisión de la juez Tanya S. Chutkan, del Distrito de Columbia, que impidió que este lunes se llevara a cabo la que habría sido la primera ejecución federal desde 2003.
La magistrada falló a favor de cuatro condenados a muerte que desafiaron en los tribunales los nuevos protocolos de ejecución presentados por la Administración de Donald Trump el pasado verano.
Chutkan coincidió con los demandantes en que los nuevos protocolos podrían suponer una violación de la Octava Enmienda de la Constitución, que prohíbe expresamente las “penas crueles”, debido a que la droga utilizada ahora para las ejecuciones de presos “produce sensación de ahogamiento y asfixia” provocando “dolor excesivo, terror y pánico”.
“La naturaleza de último minuto de este fallo es desafortunada (...) pero es resultado de la decisión del Gobierno de acortar los plazos de ejecución a pesar de que hay muchos casos, incluidos los aquí presentados, aún pendientes”, sostuvo la juez, que ya el pasado noviembre falló en el mismo sentido pero su decisión fue revertida en apelación y el Tribunal Supremo se negó a conocer el caso.
En esta ocasión el Supremo ha considerado que los prisioneros en el corredor de la muerte no han demostrado “lo requerido para justificar una intervención de último minuto”, según informa el diario ‘The Washington Post’. El fallo ha contado con la opinión desfavorable de los jueces Stephen Breyer y Sonia Sotomayor, a los que se han sumado Ruth Bader Ginsburg y Elena Kagan.
El Departamento de Justicia había apelado el fallo de Chutkan tanto ante el Tribunal de Apelaciones para el Circuito del Distrito de Colombia como ante el Tribunal Supremo, si bien el primero se inhibió a última hora del lunes, dejando a la más alta instancia judicial del país la decisión final.
Para este lunes estaba prevista la ejecución por inyección letal de Daniel Lewis Lee en Indiana. Lee fue condenado en 1999 por asesinar a tres miembros de una misma familia, entre ellos una niña de 8 años, junto a otro hombre. Ambos formaban parte de un grupo que pretendía crear una comunidad supremacista blanca.
